When I first moved into this apt, the smoke alarm kept going off every time I used my oven. I mentioned it to the landlord and she told me that the alarm was sensitive. It was driving me nuts, so I went to check to see if maybe it was a bad battery. When I went to check, I barely touched the alarm and it fell down hanging by one wire. There were 3 wires all together and two of them became unattached when the alarm fell. I made a request to have a maintenance worker come and fix it. The maintenance guy fixed it swearing the whole time, because the fire alarm was also wired to other things like the hallway light. The wires were jammed packed into this little area and the wires were really short and frustrating to attach. He ended up giving me a new alarm because the other one was bad. He swore that he checked and tested it before I moved in. Ya right. Anyways, the next day I got a letter from the manager saying that I had signed an Agreement, when I moved in, saying that resident is not to remove, disconnect or otherwise interfere with the device and the next time they were going to fine me 0. I looked for my copy of the Agreement and noticed that she had not marked the items on my copy, saying she had notified me of the alarm, sprinkler system, smoking policy, etc., etc., but were marked on the notice. In other words, she marked the notice copy but did not on my copy when I moved in. I had only moved in 2 days prior.
Besides this being "shady" and deceitful, is there any legal issue here? Part of the alarm going off I think was due to the the oven not having a seal around the door which took them 2 1/2 mos. months to fix. I think they just wish I would go away.
It also states in the contract that I am responsible to maintain the smoke detector at my own expense and that I had been shown how the device is tested. Not. Since I have been here (2 1/2 mos.) I have received a nasty note by the owners regarding my reference, damage deposit, and rent check didn’t go through right away due to fraud activity in my checking account but did go through on the 4th which is before their delinquent date of the 5th. so I received a notice to pay a nsf fee and a late fee on the 4th. Great way of making a impression as a new tenant. 10 car loads of Home Land Security showed up at my next door neighbor’s apt with rifles drawn, my car was broken into the first night I was here, my garage was vandalized recently, had to complain about the loud music from next door and I get to overlook a beautiful sight of cigarette butts all over the lawn. Do I have any legal ground to move to a better apt where they actually follow though with their contracts? Thank you.
This happened the first day I moved in so the oven was clean. In case there were any looming cleaner that would cause fumes, I wiped the oven out with clear water to get rid of any fumes that might be making the alarm go off. Also, how can I maintain the alarm at my expense, but not be able to touch it to replace a bad battery?
